Press release by the NRW Working Group "Study and Disability" on a recent OVG judgement
According to a press release issued by the NRW Working Group "Study and Disability" on a recent OVG judgement, the rights of disabled students are being violated. Universities are advised not to follow this example.
The speakers of the working group take a critical position on a recent OVG judgement which classifies a mental illness in adulthood as "permanent" and thus excludes it from the obligation to grant compensation for disadvantages. "Once again, a decision by the Higher Administrative Court of Münster on 7 November 2019 violates applicable national and international law. It was decided that a student suffering from a so-called permanent illness, i.e. non-physical disabilities which, according to the court, characterise the performance of the candidate as a "personality trait", is not to be granted compensation for disadvantages when taking examinations.
